Elements of a Copyright Infringement Claim

The following elements must be included in your copyright infringement claim:

Our Takedown Process

Upon receipt of a valid DMCA notice containing all the information listed above, Jomti will:

  1. Remove or disable access to the allegedly infringing material within 48 hours.
  2. Notify the user who posted the content of the removal and provide them with a copy of the notice.
  3. Terminate the accounts of users who are determined to be repeat infringers (those who have received more than two valid DMCA notices).

Counter-Notification Process

If your content was removed due to a DMCA notice and you believe you have the right to post it, you may submit a counter-notice to [email protected]. Your counter-notice must include:

  1. Your physical or electronic signature.
  2. Identification of the material removed and its location before removal.
  3. A statement under penalty of perjury that you have a good faith belief the material was removed by mistake.
  4. Your name, address, and phone number.
  5. A statement that you consent to the jurisdiction of the Federal District Court for your judicial district (or the jurisdiction of Moroccan courts).

If we receive a valid counter-notice, we will forward it to the original complainant. If we do not receive notice that they have filed a court action within 10-14 business days, we may restore the removed content.
